01

What Is Probate and When Is It required?

What is Probate and when is it required? Probate is the legal and financial process of dealing with the property, money and possessions of a person who has died.

02

Our Grant of Probate Application Service

If the estate you are dealing with is fairly straightforward, you may just want help in applying for the Grant of Probate itself, leaving you to then deal with the administration of the estate once the Grant is received. We can handle this for you, charging a fixed fee, agreed in advance and only payable once you start to receive in monies from the estate.

03

Our Complete Probate Service

We can take full responsibility for obtaining the Grant of Probate and dealing with all the legal, tax, property and estate administration work, all for an agreed fixed fee, payable from the estate, with no upfront costs. Once we have provided you with a written quote for the work, that price won’t change unless the original information is found to be incorrect or incomplete.

How can we help you with probate?

At Marshall & Co, we understand that navigating probate can be daunting, but our probate services aim to ease the burden during this challenging time.

We offer comprehensive assistance in managing the legal and financial complexities of probate, ensuring a smooth and efficient process. Our expert team provides guidance on everything from gathering and valuing assets to filing the necessary paperwork with HMRC and the Probate Registry to obtain the Grant of Probate. With our support, you can confidently navigate the probate process whilst honouring your loved one's wishes and ensuring an ordered distribution of assets.

  • Probate is the legal process of administering a deceased person's estate, ensuring their debts are paid and assets are distributed according to their will. It's typically necessary when the deceased owned assets solely in their name.

  • The duration of probate varies depending on factors such as the complexity of the estate, any disputes that arise etc. On average, probate can take anywhere from several months to a few years to complete.

  • Not necessarily. Small estates with limited assets may qualify for simplified probate procedures or even avoid probate altogether. Assets held jointly with rights of survivorship, assets with designated beneficiaries (like life insurance policies or retirement accounts), and assets held in trusts typically bypass probate.
